The Personal Data Protection Act 2010 (hereinafter referred to as the “PDPA”), which regulates the processing of personal data in commercial transactions, applies to Nature of Life Trading Sdn Bhd (hereinafter referred to as “NOLT”, “our”, “us” or “we”). For the purpose of this written notice, the terms “personal data” and “processing” shall have the meaning prescribed in the PDPA.The Personal Data Protection Act 2010 (hereinafter referred to as the “PDPA”), which regulates the processing of personal data in commercial transactions, applies to Nature of Life Trading Sdn Bhd (hereinafter referred to as “NOLT”, “our”, “us” or “we”). For the purpose of this written notice, the terms “personal data” and “processing” shall have the meaning prescribed in the PDPA.
 
1. This written notice serves to inform you that your personal data is being processed by or on behalf of NOLT and you hereby consent to the processing of your personal data.
 
2. The personal data processed by us may include without limitation your name, national identity card no. (NRIC no.), passport number, contact number, address, email address, photograph, designation, company name, Capital Markets Services Representative’s Licence Number (CMSRL Number), Employees of Registered Person Number (ERP Number), Federation of investment Managers Malaysia’s  License Number (FIMM Number) ,qualifications and all other details provided by you in the documents as prescribed in Paragraph 4 of this notice.    
 
3. We are processing your personal data, including any additional information you may subsequently provide, for the following purposes (“Purposes”):
(a) performing our contractual obligation with you (or your company/your employers or any organisation that you may represent/act as an agent for, if  applicable);
(b) providing our products and services in relation to our training programmes and/or consultancy services ;
(c) providing you with information and/or the latest updates on our training programmes, certification/qualification programmes if we offer the same
(d) performing all functions related to our appointment of you as our service provider;
(e) to perform all functions related to our procurement and payment processes;
(f) to invite your participation in our events, education programmes and activities ;
(g) provide you with services and updates in relation to our public education programme ;
(h) administer and conduct programmes in accordance with CPE/CPD/PRS requirements;
(i) conducting internal activities such as market surveys, trend analysis, data analytics to improve our products and services; and
(j) any purpose related to the foregoing
 
4. Your personal data is and will be collected from you/your employers/organisation  and/or from the information you have provided: 
(a) on the website and your emails;
(b) on the social media platform which includes Facebook and Instagram, in the event you use your social media account identity to sign in to our Nature of Life Trading Sdn Bhd website or application 
(c) in all forms associated with training and certification, functions and events including but not limited to the programme registration forms; 
(d)in all corresponding documents such as but not limited to agreements, quotation and invoices;
(e) through your participation in our activities and programmes; and
(f) any information that you/your organisation have provided and will provide us from time to time.
(g) when your employer/the organisation you represent/are an agent for enrolls you for any of our training courses/programmes 

5. You may access and request for correction of your personal data and to contact us with any enquiries or complaints in respect of your personal data (including the possible choices and means for limiting the processing of your personal data or to cease or not begin processing your personal data for purposes of direct marketing) from:

In accordance with the PDPA:
(a) We may charge a prescribed fee for processing your request for access or correction of your personal data; and
(b) We may refuse to comply with your request for access or correction to your personal data and if we refuse to comply with such request, we will inform you of our refusal and the reason for our refusal.

6. Your personal data may be disclosed to parties such as but not limited to your employers/organisation, regulatory and/or statutory bodies especially in connection with your license, and any such third party requested or authorised by you for any of the above Purposes or any other purpose for which your personal data was disclosed at the time of its collection or any other purpose directly related to any of the above Purposes.
 
7. If you fail to supply to us the above personal data, we may not be able to process your personal data for any of the above Purposes.
 
8. Your personal data may be transferred to a place outside Malaysia.
 
9. You are responsible for ensuring that the personal data you provide us is accurate, complete and not misleading and that such personal data is kept up to date. 
 
10. By continuing to use our services/attending our training programmes/courses, you are deemed to have agreed to the provisions of this PDPA notice. 
 
11. We reserve the right to amend this notice at any time and will place notice of such amendments on this terms and conditions/PDPA Notice page or on our website  or via any other mode that we view suitable.
 
12. In the event of any inconsistency between the English version and the Bahasa Malaysia version of this notice, the English version shall prevail over the Bahasa Malaysia version

Akta Perlindungan Data Peribadi 2010 (selepas ini disebut sebagai “PDPA”) yang mengawal selia pemprosesan data peribadi untuk tujuan transaksi komersial adalah terpakai terhadap Nature of Life Trading Sdn Bhd (selepas ini disebut sebagai “NOLT”, “kami”, atau “kita”). Dalam notis bertulis ini, terma-terma “data peribadi” dan “pemprosesan” mempunyai maksud seperti yang ditakrif dalam PDPA.

1. Notis bertulis ini bertujuan untuk memaklumkan kepada anda bahawa data peribadi anda sedang diproses oleh atau bagi pihak NOLT dan anda bersetuju kepada pemprosesan data peribadi anda.

Data peribadi yang diproses oleh pihak kami termasuk tanpa had nama, nombor kad pengenalan (No.KP), nombor pasport, nombor telefon, alamat, alamat e-mel, gambar, jawatan, nama syarikat, nombor Lesen Wakil Peniaga Pasaran Modal (Nombor CMSRL), Nombor Pekerja Kepada Orang Berdaftar (Nombor ERP ), Nombor Lesen Federation of Investment Managers Malaysia (lessen FIMM)  kelayakan dan butiran-butiran yang lain yang anda telah berikan kepada kami yang terkandung di dalam dokumen dokumen seperti yang ditetapkan dalam Perenggan 4 notis ini.

3. Kami sedang memproses data peribadi anda termasuk apa-apa maklumat tambahan yang mungkin anda berikan kemudian untuk maksud-maksud berikut (“Maksud-maksud”):
(a) melaksanakan kewajipan kontraktual kami dengan anda (atau syarikat anda/majikan anda atau organisasi yang anda mewakali/merupakan agen untuk, jika terpakai)
(b) memberikan  produk dan perkhidmatan yang berkaitan dengan program-program latihan kami dan/atau khidmat nasihat;
(c) memberikan maklumat dan/atau perkembangan terkini mengenai program latihan, program pensijilan/kelayakan (sekiranya kami berbuat demikian)
(d) melaksanakan semua fungsi berkaitan dengan pelantikan anda sebagai pembekal perkhidmatan kami;
(e) melaksanakan semua fungsi berkaitan dengan pemerolehan dan proses pembayaran NOLT;
(f) Untuk menjemput penyertaan anda untuk acara-acara, program-program pendidikan dan aktiviti-aktiviti NOLT;
(g) memberikan perkhidmatan dan maklumat terkini  berkenaan  dengan program-program pendidikan awam kami;
(h) untuk memenuhi keperluan perlesenan dan pematuhan CPE/CPD/PRS
(i) menjalankan kegiatan dalaman seperti tinjauan pasaran, analisis kecenderungan dan analisis data untuk menambahbaik produk dan perkhidmatan kami; dan
(j) apa-apa maksud lain yang berkaitan dengan yang tersebut di atas.

4. Data peribadi anda akan dan telah dikumpulkan daripada anda dan/atau maklumat yang anda/organisasi anda/majikan anda telah berikan  kepada kami:
(a) di laman web dan melalui e-mel anda;
(b) di platform-platform media sosial termasuk tanpa had seperti Facebook dan Instagram (sekiranya anda mengunakan identity social media anda untuk log masuk ke dalam laman web/applikasi Nature of Life Trading Sdn Bhd) ;
(c) semua borang-borang yang berkaitan dengan program-program latihan dan pensijilan atau kelayakan, fungsi-fungsi dan acara termasuk tetapi tidak terhad kepada borang pendaftaran program;
(d) semua dokumen yang bersamaan seperti tetapi tidak terhad kepada perjanjian, sebut harga dan invois;
(e) melalui penyertaan anda di dalam aktiviti-aktiviti dan program-program kami; dan
(f) apa-apa maklumat yang anda telah berikan dan akan beri keapda kami dari semasa ke semasa
(g) semasa majikan anda/organisasi yang anda menjadi wakil/agen mendaftar penyertaan anda untuk menyertai program Latihan yang di adakan oleh pihak kami.

Anda boleh mengakses dan memohon untuk membuat pembetulan terhadap data peribadi anda serta menghubungi kami untuk sebarang pertanyaan atau aduan berkenaan dengan data peribadi anda (termasuk pilihan-pilihan dan cara-cara yang mungkin untuk mengehadkan pemprosesan data peribadi anda atau untuk memberhentikan atau tidak memulakan pemprosesan data peribadi anda bagi tujuan pemasaran langsung) daripada:

Selaras dengan PDPA:
(a) Kami berhak untuk mengenakan bayaran fee yang ditetapkan untuk pemprosesan permintaan anda untuk mengakses atau membuat pembetulan data peribadi; dan
(b) Kami berhak untuk tidak mematuhi permintaan anda untuk mengakses atau untuk membuat pembetulan ke atas data peribadi anda dan sekiranya kami enggan mematuhi permintaan tesebut, kami akan memaklumkan kepada anda tentang keengganan kami berserta alasan-alasan kami.

6. Data peribadi anda mungkin dizahirkan kepada pihak seperti tetapi tidak terhad kepada, majikan/organisasi anda, badan-badan pengawalseliaan tertutamanya bagi tujuan perlesenan dan/atau berkanun, rakan kongsi, pembekal perkhidmatan dan mana-mana pihak ketiga seperti yang diminta atau dibenarkan oleh anda untuk mana-mana Maksud-maksud yang dinyatakan di atas atau untuk maksud lain di mana maklumat peribadi anda telah dizahirkan pada masa pengumpulannya atau untuk maksud lain yang mempunyai hubungan secara langsung dengan mana-mana Maksud-maksud yang dinyatakan di atas.

7. Sekiranya anda gagal untuk memberikan kepada kami data peribadi anda seperti yang dinyatakan di atas, maka kami mungkin tidak dapat memproses data peribadi anda untuk Maksud-maksud yang dinyatakan.

8. Data peribadi anda mungkin dipindahkan ke lokasi-lokasi di luar Malaysia.

9. Anda bertanggungjawab untuk memastikan bahawa data peribadi yang anda berikan kepada kami adalah tepat, lengkap, tidak mengelirukan dan terkini.

10. Dengan mengunakan perkhidmatan kami, anda bersetuju dengan kandugan Notis PDPA ini. .

11. Kami berhak untuk meminda Notis ini pada bila-bila masa dan akan memberikan notis mengenai pemindaan tersebut di dalam Notis PDPA atau melalui cara lain yang kami pertimbangkan adalah sesuai.

12. Sekiranya terdapat sebarang ketidakseragaman di antara versi Bahasa Inggeris dan Bahasa Malaysia ke atas Notis ini, maka versi Bahasa Inggeris akan digunakan.



Terms & Conditions of Use


This agreement applies as between you, the User of this Website and Nature of Life Trading Sdn Bhd, the owner(s) of this Website. Your agreement to comply with and be bound by Clauses 1, 2, 4 – 11 and 15 – 25 of these Terms and Conditions is deemed to occur upon your first use of the Website. Clauses 3 and 12 – 14 apply only to the sale of Services. If you do not agree to be bound by these Terms and Conditions, you should stop using the Website immediately.

No part of this Website is intended to constitute a contractual offer capable of acceptance. Your order constitutes a contractual offer and Our acceptance of that offer is deemed to occur upon Our sending a confirmation email to you indicating that your order has been accepted.

1. Definitions and Interpretation

In this Agreement the following terms shall have the following meanings:
Account:   means collectively the personal information, Payment Information and credentials used by Users to access Paid Content and / or any communications System on the Website;
Content:   means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Website;
Facilities:   means collectively any online facilities, tools, services or information that Nature of Life Trading Sdn Bhd makes available through the Website either now or in the future;
Services:   means the services available to you through this Website, specifically use of the Nature of Life Trading Sdn Bhd proprietary e-learning platform;
Payment Information:   means any details required for the purchase of Services from this Website. This includes, but is not limited to, credit / debit card numbers, bank account numbers and sort codes;
Premises:   Means Our place(s) of business located at 27th Floor, Axiata Tower, Jalan Stesen Sentral 5, 50470 Kuala Lumpur;
System:   means any online communications infrastructure that Nature of Life Trading Sdn Bhd makes available through the Website either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities and email links;
User / Users:   means any third party that accesses the Website and is not employed by Nature of Life Trading Sdn Bhd  and acting in the course of their employment;
Website:   means the website that you are currently using (www.natureoflife.training) and any sub-domains of this site
We/Us/Our:   means Nature of Life Trading Sdn Bhd , a company incorporated with the Registrar of Companies for Malaysia with Company registration Number 911808-K.
Note : We do not require any payment information where the services are provided to you at the request of your employers/organisations that you represent who have an arrangement with us to provide our training programmes to you, for which your participation has been approved by them.  However, if you enrol directly with us, you would need to purchase your training programme from us, in which case , any applicable payment would need to be made by you to us, for your order. 

2. Age Restrictions

Persons under the age of 18 should use this Website only with the supervision of an Adult. Payment Information must be provided by or with the permission of an Adult.

3. Business Customers

These Terms and Conditions also apply to customers procuring Services in the course of business.

4. Intellectual Property

  • 4.1 Subject to the exceptions in Clause 5 of these Terms and Conditions, all Content included on the Website, unless uploaded by Users/Identified as being from outside sources , and including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Nature of Life Trading Sdn Bhd, Our affiliates or other relevant third parties. By continuing to use the Website you acknowledge that such material is protected by applicable Malaysian and International intellectual property and other laws. 
  • 4.2  You may not reproduce, copy, distribute, store or in any other fashion re-use material from the Website unless otherwise indicated on the Website or unless given Our express written permission to do so.

  • 9.2 You acknowledge that Nature of Life Trading Sdn Bhd reserves the right to monitor any and all communications made to Us or using Our System.
  • 9.3 You acknowledge that Nature of Life Trading Sdn Bhd may retain copies of any and all communications made to Us or using Our System.

10. Accounts

  • 10.1 In order to procure Services on this Website and to use certain other parts of the System, you are required to create an Account which will contain certain personal details and Payment Information which may vary based upon your use of the Website as We may not require payment information until you wish to make a purchase. By continuing to use this Website you represent and warrant that:
    • 10.1.1 all information you submit is accurate and truthful;
    • 10.1.2 you have permission to submit Payment Information where permission may be required; and
    • 10.1.3 you will keep this information accurate and up-to-date. Your creation of an Account is further affirmation of your representation and warranty.
  • 10.2 It is recommended that you do not share your Account details, particularly your username and password. We accept no liability for any losses or damages incurred as a result of your Account details being shared by you. If you use a shared computer, it is recommended that you do not save your Account details in your internet browser.
  • 10.3 If you have reason to believe that your Account details have been obtained by another person without consent, you should contact Us immediately to suspend your Account and cancel any unauthorised orders or payments that may be pending. Please be aware that orders or payments can only be cancelled up until provision of Services has commenced. In the event that an unauthorised provision commences prior to your notifying Us of the unauthorised nature of the order or payment then you shall be charged for the period from the commencement of the provision of services until the date you notified us and may be charged for a billing cycle of one month.
  • 10.4 When choosing your username you are required to adhere to the terms set out above in Clause 9. Any failure to do so could result in the suspension and/or deletion of your Account.

11. Termination and Cancellation of Accounts

  • 11.1  Nature of Life Trading Sdn Bhd  may terminate your Account. If We terminate your Account, you will be notified by email and an explanation for the termination will be provided. Notwithstanding the foregoing, We reserve the right to terminate without giving reasons. no refunds will be made if you have enrolled for a course, and have started to access the course. 
  • 11.2 If We terminate your Account, any current or pending orders or payments on your Account will be cancelled and provision of Services will not commence.

12. Services, Pricing and Availability

  • 12.1 Whilst every effort has been made to ensure that all general descriptions of Services available from Nature of Life Trading Sdn Bhd correspond to the actual Services that will be provided to you, We are not responsible for any variations from these descriptions as the exact nature of the Services may vary depending on your individual requirements and circumstances. 
  • 12.2 Where appropriate, you may be required to select the required Plan of Services.
  • 12.3 We neither represent nor warrant that such Services will be available at all times and cannot necessarily confirm availability until confirming your Order. Availability indications are not provided on the Website.

13. Orders and Provision of Services

  • 13.1 No part of this Website constitutes a contractual offer capable of acceptance. Your order constitutes a contractual offer that We may, at Our sole discretion, accept. Our acceptance is indicated by Us sending to you an order confirmation email. Only once We have sent you an order confirmation email will there be a binding contract between Nature of Life Trading Sdn Bhd and you. The company you are attached to/work for  or perform services for may request us to enroll you for our courses directly, in which case you are deemed to have consented to being enrolled for the said course, and an email will be sent to you, notifying you of the enrollment, at which point you may request to be removed if you so require,  
  • 13.2 Order confirmations under sub-Clause 13.1 will be sent to you before the Services begin and shall contain the following information:
    • 13.2.1 Confirmation of the Services ordered 
    • 13.2.2 .Relevant times and dates for the provision of the Services; (if applicable.)
    • 13.2.3 Relevant information for accessing those services
    • 13.2.4 Relevant information for accessing those services.
  • 13.3 If We, for any reason, do not accept your order, no payment shall be taken under normal circumstances. In any event, any sums paid by you in relation to that order will be refunded .
  • 13.4 Payment for the Services shall be taken via your chosen payment method, immediately for any setup fee that corresponds to the service plan you purchased and at the same day of each subsequent month (“billing cycle”) for charges accrued during the previous month (“billing cycle”) AND/OR as indicated in the order confirmation you received. This depends on whether you have selected the course you have selected has a one off payment, or recurring/installment payment option. 
  • 13.5 We aim to fulfill your Order within 2-3 working days or if not, within a reasonable period following your Order, unless there are exceptional circumstances. If we cannot fulfill your Order within a reasonable period, we will inform you at the time you place the Order by a note on the relevant web page or by contacting you directly after you place your Order. Time is not of the essence of the Contract, which means we will aim to fulfill your Order within any agreed timescales but this is not an essential term of the Contract and we will not be liable to you if we do not do so. If the Services are to begin within 14 calendar days of Our acceptance of your order, at your express request, you will be required to expressly acknowledge that your statutory cancellation rights, detailed below in Clause 14, will be affected.
  • 13.6 Nature of Life Trading Sdn Bhd shall use all Our reasonable endeavours to provide the Services with reasonable skill and care, commensurate with best trade practice. 
    IMPORTANT : The dates chosen  for updating CPE/CPD points will be made solely by Nature of Life Trading Sdn Bhd. You are advised to enroll for your course one month prior to your points expiring. Nature of Life Trading Sdn Bhd will not be held responsible for any failure to renew your CPE/CPD points as the case may be.

      • 17.1 We make no warranty or representation that the Website will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. We make no guarantee of any specific results from the use of our Service or Services.
      • 17.2 No part of this Website is intended to constitute advice and the Content of this Website should not be relied upon when making any decisions or taking any action of any kind.
      • 17.3 No part of this Website is intended to constitute a contractual offer capable of acceptance.
      • 17.4 Whilst We use reasonable endeavours to ensure that the Website is secure and free of errors, viruses and other malware, you are strongly advised to take responsibility for your own internet security, that of your personal details and your computers.

      18. Changes to the Facilities and these Terms and Conditions

      We reserve the right to change the Website, its Content or these Terms and Conditions at any time. You will be bound by any changes to the Terms and Conditions from the first time you use the Website following the changes. If We are required to make any changes to these Terms and Conditions by law, these changes will apply automatically to any orders currently pending in addition to any orders placed by you in the future.

      19. Availability of the Website

      • 19.1 The Website is provided “as is” and on an “as available” basis. Nature of Life Trading Sdn Bhd will endeavour to provide a high uptime, including a fault-tolerant architecture hosted in cloud servers. We give no warranty that the Website or Facilities will be free of defects and / or faults and we do not provide any kind of refund for outages. We provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.
      • 19.2 We accept no liability for any disruption or non-availability of the Website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.

      20. Limitation of Liability

      • 20.1 To the maximum extent permitted by law, We accept no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Website or any information contained therein. You should be aware that you use the Website and its Content at your own risk.
      • 20.2 In the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these Terms and Conditions and shall not affect the validity and enforceability of the remaining Terms and Conditions. This term shall apply only within jurisdictions where a particular term is illegal.

      21. No Waiver

      In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.

      22. Previous Terms and Conditions

      In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.

      23. Third Party Rights

      Nothing in these Terms and Conditions shall confer any rights upon any third party. The agreement created by these Terms and Conditions is between you and Nature of Life Trading Sdn Bhd.

      24. Communications

      • 24.1 All notices / communications shall be given to Us either by post to Our Premises (see address in the PDPA notice) or by email to support@natureoflife.training. 
      • 24.2 We may from time to time, if you opt to receive it, send you information about Our products and/or services. If you do not wish to receive such information, please click on the ‘Unsubscribe’ link in any email which you receive from Us.

      25. Law and Jurisdiction

      These Terms and Conditions and the relationship between you and Nature of Life Trading Sdn Bhd shall be governed by and construed in accordance with the Laws of Malaysia and Nature of Life Trading Sdn Bhd and you agree to submit to the exclusive jurisdiction of the Courts of Malaya
